Corporations are People, Too!

Lawyers are fond of pointing out that corporations are legal “persons.” For this reason, and much to the chagrin of Eugene Volokh, lawyers often use a different word, such as “individuals,” to describe what normal people would call, well, “people.”

Of course it is important to be clear about what you mean. But does anyone really believe – generally, that is – that corporations are “persons?” If so, then query whether a representative of two corporations may drive in a carpool lane while on company business. Assume that the carpool lanes are labeled as they are in California, where a carpool is defined as “2 or more persons per vehicle,” and that the relevant state’s Vehicle Code either does not define the word “person” or does define in in substantially the same way California Vehicle Code § 470 does (“‘Person’ includes a natural person, firm, copartnership,
association, limited liability company, or corporation.”).
