My guess is that Arnold gave a general directive to compile a list of all post-1998 laws that cost the state money (or maybe all laws with Tom Hayden's name on them?) but no one went through the Hayden Act carefully enough to figure out why it was passed, or even that most of its provisions were budget-neutral or better.
