I don’t see the problem here. The article you linked to seems to be pointing out that existing law – passed to ban trucks, not SUVs – in fact bans SUVs as well, and (implicitly) suggests that that law should be enforced.
I can understand wanting the law changed, but how can you object to an observation that the law is, in fact, there?

I don’t object to anyone pointing out that the laws exist. I do object to the glee with with which both of them advocate that the law be enforced to the hilt, rather than fixed. “Cool. I say impound ‘em all!” is hardly what I’d call a neutral obsevation that a law is, in fact, there.

Actually, it’s a similar law that causes the evil SUV tax break. Their size puts them above some arbitraty limit so people apparently get them absolutely free, or so say the moonbats.

These people are such whiners. I drive a Honda accord because I’ve got a 150 mile commute, but these SUVs on I-80 don’t bother me in the slightest. The impulse that drives people to have license plates like “SUVFREE” is totally alien to me. Like I need to tell another person what to do with their time and money.

I just think it’s stupid to ban vehicles by gross capacity rather than their actual working mass, and I think the Slate author is very sloppy for occasionally conflating gross capacity with actual curb weight. (Contra him, a Hummer does not weigh 10,000 pounds, though it does exceed 6000.)
Only the heaviest SUVs of each manufacturer (ie, in Ford’s case, the Excursion alone) is over 6000 pounds, which is also the case for most “un-objectionable” heavy durty pickup trucks (ala the F350, etc.).
The anti-SUV people should go back to simply admitting their opposition is aesthetic and puritanical.

Tax break, yes, if the vehicle is used primarily for business. “Almost free?” Nah. It’s almost free like the interest on your mortgage is almost free.

Atlanta traffic is bad enough without some a-hole in an SUV running me and my Chevy Cavalier off the road. The money I saved in gas went to pay for a .44 Magnum, which stays, loaded, in the glove compartment.
