		<description>Joel: No one is going to be disbarred. I have no doubt intellectually Geragos knew he was going to lose. However, psychologically he was not prepared for it. In my opinion, that is what he meant. Years ago a supervisor of mine moved for a continuance explaining he had completed several back to back trials and was unprepared for the case now before the court. The court denied his motion. The court of appeal found that he was not ineffective and even praised him. Appellate courts look to see whether performance fell below the prevailing standards, not at comments made it court as proof of ineffective assistance of counsel.</description>

Certainly if one was incorrectly or unjustly convicted one would prefer the death sentence as the odds of reversal are (far?) higher than those of execution, while with &quot;life&quot; it&#039;s a struggle to get an appeal heard.</description>
