Your explanation of the law wasn’t the problem. That part was fine. What was not fine was your credulous assumption that the requirements of the law were not met in this case. Could a group of people who all happen to be members of Race A attack another group of people who all happen to be members of Race B, for reasons other than race? Sure. Could they do so even though they shout racial ephithets at them? Possibly, but only if they had some perverse reason to want their crime to look racially motivated when it wasn’t.

I think people are capable of using racial epithets in order to hurt but not because of underlying bias. However it does look weird to see a prosecutor not papering a criminal. I mean, look how they handled the NYC protester prosecutions.
