Of Clouds and Silver Linings
Silver Lining: Justice Alito was confirmed.
Small Cloud: Overzealous legislators in Georgia, Indiana, Ohio, South Dakota and Tennessee appear to have fallen for the NOW/NARAL/Boxer “just one vote” lie. If any of these proposals go through, the Supremes will reaffirm Roe, converting it from the super-precedent it is today into the super-duper pooper scooper precedent Arlen Specter would like it to be. Make no mistake about it: if Roe is revisted by the present Supreme Court, it will be affirmed; the only question is whether it will be reaffirmed by the expected 5-4 margin, or whether John Roberts really meant it when he described the case as “settled law” (unless, of course, he meant it in the sense of “settled until I get my cotton pickin’ hands on it”).
Bigger Cloud: It’s looking more and more like I’ll owe Paul Deignan a bottle of wine in ‘09.

Could you please explain to me how a decision that Senators grill every prospective nominee about, and the public considers on a knife-edge of judicial whim, can possibly be as settled a law as, say, Plessy was in 1950? Just asking.
