Here’s the strongest evidence to date that the Bush Administration’s “domestic” surveillance program is legal: Arlen “Superprecedent” Specter thinks it isn’t.
UPDATE: If that didn’t cinch it, surely this will.

President Carter lost his re-election effort because he was unwilling to provide security for this nation and apparently he hasn’t learned a thing. Spector I can understand (He is just a Legislator who wants to expand the power of Congress over the power of the Executive branch). But you’d kind of think President Carter would steer clear of embarrassing himself and confirming his status as the most clueless President in this nation’s history. Carter is a nice person, but totally out of his depth in foreign policy issues and security issues. What an embarrassing figure he is. He’d do much better just smiling and keeping his mouth shut. Another case of better being silent and thought a fool than speaking and removing all doubt.

I wish someone could tell me why it’s OK for government agents to search me and my posessions — as a matter of routine — should I seek to take a domestic airline flight, but can’t “search” an international phone call I might make to a known terrorist.
Clearly there is no argument of necessity separating the two cases. Why is one more “unreasonable” than the other?

I don’t think there is a non-frivolous “reasonableness” argument separating the two, only the question of whether one is legal and the other not. AFAIK FISA does not apply to airline searches.
