Via Say Uncle, David Hardy has the goods on how Frank Lautenberg’s gun law and Timothy Emerson’s adulterous and mendacious ex have conspired to destroy him. Truly disgusting, especially when you consider that Emerson’s case was the “good” Second Amendment case.

It does not sound kosher, x. As I understand the Lautenberg Amendment, a criminal conviction (reasonable doubt) for domestic violence is required. The run of the mill protective orders (ex parte, divorce court, civil rules, no right to a jury trial) don’t count. I’ll try to research it (maybe find the opinion in Dr. Emerson’s case) and comment again.

My mistake. A civil order (no jury, no reasonable doubt) does count under (g)(8). (g)(9) is the domestic violence conviction. Sorry.
