Pattericos excepted, DAs really need to have the spectre of criminal prosecution hanging over their heads if they get a case way wrong. It certainly appears as though the DA is moving far too fast on this case and getting ahead of himself. He should not be allowed to destory people’s lives without consequence to himself.

Here in the Raleigh-Durham area, coverage of the story seems to have been non-stop for the past month. It’s rather sickening.
The prosecution of this case appears rather unseemly. A DA with an election in only a couple of weeks seeks indictment of at least one defendant with a very strong alibi… but there’s no chance he’s doing it to throw a bone to a large segment of his electorate, is there?
I’m going to make a SWAG on this: after Nifong wins his election (I think he’s in the lead, I might be wrong) the exculpatory evidence will result in the charges being dropped before the case ever goes to trial.
Frankly, it sounds to me like politically-motivated prosecutorial misconduct, WRT that one defendant. But there’s an election, and he needs a scalp.

As a fellow deputy district attorney once said to me “Any prosecutor can convict a guilty man, but it takes a great one to convict an innocent man.” I guess on that basis Nifong appears to be attempting to achieve greatness.
