		<description>I disagree.  The people are not a governmental body, and while they certainly do have the power to amend or repeal Section 308.5, or even to amend the California Constitution if necessary, they don&#039;t have any power to interpret laws.  That&#039;s pretty basic stuff, enough so that it&#039;s a surprise they bothered to say that in the text of bill.

Section 8 is, however, incorrect in two other respects.  For one thing, it is not true that the supposed constitutional infirmities with Section 308.5 &quot;cannot be corrected by the Legislature&quot; - they just can&#039;t be corrected by the Legislature &lt;i&gt;alone.&lt;/i&gt;  For another, there is no basis whatsoever for the Legislature to say Section 308.5 &quot;addresses only marriages from other jurisdictions.&quot;  The simply made that up.</description>
