		<description>This is hardly something new.  The Democrats, thanks in part to John Edwards, are seeing populism as a great means to win votes.  Well, populism requires an evil &quot;them,&quot; who are stealing money that&#039;s rightfully ours, and taking away the rights taht are just naturally ours, damn it!

But what populism also requiers is an ignorance of economics and the law.  Don&#039;t expect the lovely Mrs Clinton to pay any attention to what she should have learned in law school if such would get in the way of her pandering for votes.</description>

		<description>I think if a private actor takes on a function of the state in certain circumstances they can be held to have violated the Constitution in a Bivens-type action.  But of course Hillary thinks insurance is a core Government funtion.</description>
