Saving Marriage

Ed Morrissey whines but I say heh. One side of me almost hopes this initiative passes. Yes, I really do hate California that much.

    I don’t see why it would be so bad if it passes…If you want a divorce go to Nevada, clears up like oh 50% of our court calendar, and heck if you do get married, stay married, I’m for that.

    Um, it wouldn’t be quite that simple. Unless, of course, by “go to Nevada” you meant actually move there with the intent of remaining indefinitely. Generally speaking, you can’t get a divorce in a state where neither party to the marriage resides. For some reason I’ll never understand, the same rule does not apply to getting married in the first place.

    I thought it used to be (before California “deregulated” divorce) that people who wanted to get divorced for a no-fault reason would move to Nevada for something like 7 days and then they would qualify for divorce.

    I have no doubt that if California “re-regulated” divorce Nevada would step in that “business” opportunity.

    I’m pretty sure it’s more like a month of residency, and even then the divorce can be voided if you were not a bona fide resident. Nevada could abolish this requirement but then other states wouldn’t have to recognize it.
